Traffic Law in North Carolina

Knowing and respecting the rules of the road will ensure you maintain your license and promotes the safety of all travelers.

The most common traffic violations are speeding and expired registration.  Other traffic matters include failing to observe traffic signals and signs, such as running a red light or stop sign, seat belt violations, child passenger restraint, DUI, texting and driving, failure to yield the right of way, and failing to adhere to the move over law.

Your driving record is one of the factors that determines how much you pay for automobile insurance.  Insurance points are incurred when you are involved in an accident that is your fault or for moving violations of which you are convicted.

Insurance points are applied during the “experience period”, which is either the three years immediately preceding the date you apply for insurance or policy renewal.

North Carolina follows a Safe Driving Incentive which prevents you from obtaining insurance points for safe driving.  However, when you fail to adhere to the safety rules and you obtain citations, your insurance can increase significantly based on the number of points you receive.

There are special exemptions to receiving insurance points under the Safe Driving Exception.

One thing many drivers are unaware of is the Driver’s License Compact Act.  States that are a member of this Act report driving violations to other member states in which the driver maintains a driver’s license.  This means, for instance, if you are licensed in North Carolina and receive a citation in California, California will report that driving violation to the North Carolina DMV and you could receive driver’s license and insurance points.

This also means that it matters how the California citation is resolved and if North Carolina has an equivalent resolution that will limit the negative consequences imposed on your North Carolina driving record.
